- Abstract
The article focuses on negotiability laws presented in Article 3 of the Uniform Commercial Code (UCC) that exhibits recovery in the residential mortgage industry. It recommends that by eliminating holder-in-due-course rule, which protects a purchaser of debt, negotiability can retain its strengths. It mentions that the financial industry of the U.S. can propose an electronic replacement for paper-based negotiable instruments and endorsements by preserving the benefits of negotiability.
