- Abstract
The article analyzes a unified test which aims to validate the judicial standards in the U.S. between subdivision of land development exactions, contemporary user impact fees, and linkage in the application of the unified test. The three governmental restrictions are defined and categorized to ensure proper implementation of the judicial test. The tests established by state courts in the country to determine the constitutionality of land exactions are explored, including reasonable relationship test, specifically and uniquely attributable test, and rational nexus test.
