- Title
CHANGING RULES OF LIABILITY IN AUTOMOBILE ACCIDENT LITIGATION.
- Authors
NIXON, RICHARD M.
- Abstract
The article offers information on the changes in the rules in the three significant fields of automobile accident law. It states that the criminal liability imposed for the failure to stop at a railway crossing, had little effect as a great proportion of them expressly stipulate that the rule of civil liability shall not be affected. It mentions that in recent years, statutes passed in several states, that motorists will not drive at such a speed, that he will be unable to stop within the assured clear distance ahead. It presents that the person having the right of way, may not exercise it without due regard for the rights of the other party, as the care to avoid collision remains reciprocal.
