- Title
THE LAUTSIDECISION AND THE AMERICAN ESTABLISHMENT CLAUSE EXPERIENCE: A RESPONSE TO PROFESSOR WEILER.
- Authors
Marshall, William P.
- Abstract
An essay is presented in response to Professor Joseph Wieler's nonestablishment interpretation of the European Convention on Human Rights regarding the European Court of Human Rights (ECHR) Lautsi v. Italy case and the U.S. Constitution Establishment Clause. The Court upheld that display of crucifixes in the Italian public school classrooms did not violate the European Convention. He informs that the nonestablishment rule does not subordinate religion to secularism, as suggested by Weiler.
