- Title
PARTIAL DECISIONS ON THE SUBSTANTIVE MATTER IN DISPUTE - IN TURKISH AND COMPARATIVE CIVIL PROCEDURE AS WELL AS IN TURKISH ARBITRATION LAW.
- Authors
LANDBRECHT, Johannes; TOKESER, Alptug
- Abstract
Focusing litigation or arbitration proceedings on specific issues, and deciding those specific issues separately, can empower the parties to settle the outstanding issues autonomously. The resolution of the overall dispute is thereby rendered more efficient. While partial decisions are difficult to implement in Turkish civil procedure law, Turkish arbitration law is sufficiently flexible for parties to reap the full benefits of partial decisions.
