- Abstract
In this research, the issue of civil liability arising from the use of technology in assisted human reproduction techniques will be analyzed. The transhumanist society is moving towards human betterment, through medicine and technology. Thus, assisted reproduction techniques must be used ethically and in compliance with the provisions of the CFM Resolutions. The use of new technologies of assisted reproduction is accepted for cases of infertility of the couple, and technological science makes it possible to make choices regarding the characteristics of the child. Thus, there are numerous cases of error when choosing the genetic material, or in its handling, which gives rise to civil liability actions against the clinics. As a general objective, it aims to evaluate the civil liability due to the error in the manipulation of sperm in the semen banks. As specific objectives, the principles applied to family planning, the transhumanist society and the use of assisted reproduction techniques are initially presented. Finally, the responsibility resulting from the error in the handling of sperm is analyzed. There will be civil liability of the semen bank and the professionals responsible for handling these materials. In this research, the hypothetical- deductive method was used, using bibliographic research for the construction of this work.
