BRINGING A LAMB TO SLAUGHTER: HOW FAMILY LAW ATTORNEYS UNKNOWINGLY LEAD CLIENTS TO FINANCIAL DISASTER IN THE NEGOTIATION OF A DIVORCE STIPULATION.
- Authors
Bjurling, Jennifer L.
- Abstract
The article discusses the relationship between the U.S. Bankruptcy Code (USBC) and American family (domestic relations) law, and it mentions how a domestic relations lawyer's lack of knowledge about the nation's bankruptcy laws can impact a client's divorce-related financial settlement. Fraudulent conveyances and divorce negotiations are addressed, along with the dischargeability of debts under Chapter 13 of the USBC. The Vermont Supreme Court divorce case Fitzgerald v. Fitzgerald is examined.
