The article focuses on accounting for new judicial approach to antitrust and hospital mergers for addressing the needs of the consumers in a progressive health care industry in the U.S. Topics discussed include brief discussion of the history of three antitrust statutes Sherman Act, the Clayton Act, and the Federal Trade Commission Act and their historical relationship to mergers in health care; problems in the hospital merger analysis; and American Medical Ass'n v. United States case on same.
