- Title
A RETURN TO HISTORY AND TRADITION: REVISITING LASSITER AND GROUNDING CIVIL GIDEON IN THE DUE PROCESS CLAUSE OF THE FOURTEENTH AMENDMENT.
- Authors
JARRETT JR., CYRUS W.
- Abstract
The article discusses the Supreme Court case Lassiter v. Department of Social Services, which denied a right to counsel for indigent civil litigants. The author argues that a broad right to counsel is deeply rooted in US history and that due process requires the appointment of counsel in many circumstances. The article criticizes the reasoning of the Lassiter decision and suggests it should be revisited and overruled. It also discusses the issue of providing legal representation to indigent individuals in civil cases and highlights the need for access to counsel in proceedings involving basic human needs. The article concludes by advocating for the establishment of a federal right to counsel for indigent civil litigants.
