Abstract
The article states that a U.S. District Court dismissed the Melvin M. Ferguson vs. SMSC Gaming Enterprise and David Whitley case due to a lack of subject matter jurisdiction. Ferguson filed the discrimination lawsuit against SMSC, which is a unit of the Shakopee Mdewakanton Sioux Community and operator of Mystic Lake Casino. He based his case on race discrimination and violation of Title VIII of the 1964 Civil Rights Act, but tribes have no liability as "employer."
