- Abstract
The article focuses on the issue of racial disparity under the U.S. federal sentencing guidelines before, and after, the Booker decision. It explores a 2010 research by the U.S. Sentencing Commission (USSC) that found greater racial disparity in sentencing after Booker. It also examines a study by Jeffrey T. Ulmer and colleagues that provides an alternative analysis to the USSC report based on different analytical and modeling choices.
