LEGAL UPDATE.
- Abstract
Several legal cases related to employee benefits, gathered in the U.S. as of June 1996, are presented. The first case involved an insurer that was discharged from all subsequent liability to rightful claimant where insurer paid survivor benefits, in good faith, to purported beneficiary without notice of any competing claims. The second case involved the denial of coverage under the ERISA health benefit plan properly upheld as exceeding coverage for mental illness. The third case had the judge ruling that mental illness benefits limitation did not apply to participant with neurological disorder. The fourth case saw a health insurance contractor as exempted from paying for treatments that are not medically necessary as defined in the health benefits contract.
