- Abstract
The article examines the interpretative problem raised by the September 30, 2013 appointment of Marc Nadon as judge on the Canadian Federal Court of Appeal under the Supreme Court Act. Particular focus is given on the opinion of former Supreme Court justice Ian Binnie that the said law permits Nadon's appointment, a conclusion endorsed by professor Peter Hogg and another former Supreme Court justice Louise Charron.
