- Abstract
The article discusses various approaches and rationales for America's judicial estoppel (JE) legal doctrine, and it mentions judicial integrity in the U.S., as well as several rulings by the nation's Supreme Court and appellate courts in cases dealing with the JE doctrine. A comparison is provided regarding the doctrines of JE, equitable estoppel, and collateral estoppel. The litigation matter Erie Railroad Co. v. Tompkins, which deals with the U.S. Rules of Decision Act, is examined.
