- Title
FINDING NIN0: JUSTICE SCALIA'S CONFRONTATION CLAUSE LEGACY FROM ITS (GLORIOUs) BEGINNING TO (BITTER) END.
- Authors
Moreno, Joëlle Anne
- Abstract
The article focuses on the legacy of the confrontation clause by Justice Antonin Scalia of the U.S. Supreme Court, which has sparked confusion in the federal and state courts. It discusses the opinion of Justice Scalia in Crawford v. Washington that confrontation is the only sign of reliability adequate to meet constitutional demands. It suggests that any effort of narrowing the focus of confrontation to improve analytic and operational consistency would require legal and social cost.
