- Abstract
This paper analyzes the application of indigenous rights regulations in the province of Neuquen during the last two decades, arguing the existence of an implementation gap. The starting point is the international change of legal paradigm in indigenous rights since the eighties and the constitutional adequations in Argentina (1994) and Neuquen (2006) to characterize the obstacles generated in the province to achieve the full implementation of the human rights of indigenous peoples, which in the studied area refer mainly to the Mapuce people. In order to do this, two dimensions are analyzed: one linked to the quarrel between the province and the nation state over the power to recognize and survey Mapuce communities, and the second one refers to the practices of the state of Neuquen to exercise the demanded power in the matter.
