- Abstract
The article discusses the U.S. court case Colby v. Union Security Insurance which deals with the definition of disability. The plaintiff filed the lawsuit under the Employee Retirement Income Security Act (ERISA) after the insurance company refused to cover her substance abuse treatment. The Court of Appeals for the First Circuit ruled that a possibility of relapse, or reoccurrence of a disabling condition, can itself be a disability.
