- Abstract
This article presents the case of the U.S. versus Charles Herbert Smith, a former public school principal with extensive personal contacts in government and education. It notes that individual convicted of operating fraudulent investment schemes cannot be forced to relinquish, for restitution, monthly retirement benefit annuity he receives from Employee Retirement Income Security Act (ERISA) pension plans because of the prohibition in ERISA against assignment or alienation of pension benefits.
