- Abstract
The article discusses the torture policy under the administration of former U.S. President George W. Bush. It notes that the Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment stresses that there are no exceptional circumstances whether state of war or a threat of war, internal political instability may be invoked to justify the legality of torture. It also notes that lawyers in the Department of Justice's Office of Legal Counsel including John Yoo requested high-ranking officials to protect them from future prosecution for subjecting detainees to torture by writing memorandums.
