- Abstract
The article focuses on the problem faced by the U.S. organic farmers, whose land is contaminated by genetically modified seed. It discusses the case of J.E.M. Ag Supply v. Pioneer Hi-Bred International in which the Supreme Court held that genetic traits of living organisms can be patented. It offers information on the products liability landscape and the bystander strict liability in tort that can be applied to the above discussed problem.
