- Abstract
The article criticizes the decision of the U.S. Court of Appeals for Tenth Circuit in the case Cook v. Rockwell International Corp. related to the claims for damages to property after the plutonium radiation from the nuclear plant to the property under the Price Anderson Act. It mentions that the court has misinterpreted the loss of use of property language in the PAA and inappropriately equated organs and real property and not raise the medical monitoring claims.
