- Abstract
We focus on the analysis of the Brazilian legislative production of the last thirteen years (2005-2017) on crimes against sexual freedom, with emphasis on rape crime. It is investigated how the Projects of this Law period is themed 'rape', more precisely, investigates the occurrence of advances regarding the rights to sexual freedom of women from this analytical framework. Thus, the general objective of this research is to understand which markers are present in the production of Draft Laws on rape in Brazil between 2005 and 2017. The authors who base this research were Martins (2012), Nucci (2009), Andrade (2004), and Coulouris (2004). Of dialectical nature and mixed approach, the research unfolds in a bibliographicexploratory study, from documentary sources, read in the light of content analysis. The conclusions reached indicate that the elaboration of norms in Brazil in the last thirteen years, timidly dialogues with the contribution to the effectiveness and advancement of the achievements and guarantees of women in relation to the protection of their sexual dignity. On the contrary, it can be seen that the Draft Laws analyzed are little or nothing related to the respect and commitment of the affirmation of the individual liberties of women, making, in numerous documents analyzed, the conservative discursive movement linked to the reinforcement of machismo, sexism and patriarchy.
