- Abstract
The article examines whether the Double Jeopardy Clause protects Leigh and other criminal defendants in similar situations and impact of judicial estoppel. It mentions using the doctrine of judicial estoppel to protect criminal defendants from subsequent prosecutions arising out of factually baseless pleas. It also mentions American plea-bargaining system and current state of the American criminal legal system.
