- Abstract
This article studies the legal and political measures adopted by the Andean Community regarding access to genetic resources and benefit sharing, based on the studies on equity in benefit distribution by Bram De Jonge and Niels Louwaar (2009). According to these authors, the abs (Access and Benefit Sharing) principle is justified by three asymmetries present in this issue. On the one hand, the double asymmetry between the assignation and the exploitation of resources, and on the other hand, the asymmetry between intellectual property rights and the legal rights of genetic resources and traditional knowledge. In this context, the Andean Community ratifies the sovereignty principles of genetic resources and abs of the cbd. Decisions 391, 486 and 523 are the main responses of the Andean Community towards this challenge: in this context, the biocan project is working on the issues of special relevance for the region, like the challenge of assigning value to genetic resources and biopiracy.
