Driving the Wage and Hour Class Action - Entrepreneurs or Employees?
- Authors
Fried, Robert; Dauscher, Scott K.; Milligan, Chris
- Abstract
The article discusses a series of wage and hour cases involving FedEx Ground. The cases have attempted to address the use of independent contractors as drivers in the U.S. The D.C. Circuit of Appeals has overruled the determination of the National Labor Relations Board that the company's drivers are incorrectly classified as independent contractors. It was found that the company's drivers are actually employees rather than independent contractors.
