- Abstract
The article reviews current law in New York as to what constitutes a valid waiver of a defendant's right to counsel at trial and right to self-representation. Topics discussed are constitutional right to the assistance of counsel and self-representation in a criminal trial under the U.S. and New York Constitutions, Court of Appeals and appellate division precedents of a defendant's waiver of right to counsel, and practical considerations for courts and counsel regarding waiver colloquies.
