- Abstract
The bargaining power of retailers, especially supermarkets, is increasing and French legislation has failed in vertical competition law. The victims are the consumers, as industrial brand prices have continuously increased since the Galland Law (1996). A new law was adopted in 2005. It changed the invoicing rules between producers and retailers, in order to encourage better profit sharing between these two players and a decrease in prices for consumers. The thesis we develop in this article is that the new rules may create new practices in the relationship, but won't change the bargaining power. And the effect on retail prices may be limited.
