- Abstract
The author argues that the U.S. Supreme Court should establish a "special needs" category for DNA forensic testimonial evidence which would allow an American trial court to balance the interests of the prosecution with the legal rights of a defendant. According to the article, the Confrontation Clause in the Sixth Amendment to the nation's Constitution provides defendants with the right to confront adverse witnesses. Judicial discretion and cross-examinations of witnesses are examined.
