- Title
A MORAL MANDATE & THE MEANING OF CHOICE: CONCEIVING THE AFFORDABLE CARE ACT AFTER NFIB.
- Authors
CLARK, BRIETTA
- Abstract
The article discusses the issues on moral mandate and consumer's choice concerning Affordable Care Act (ACA) after the decision of U.S. Chief Justice John Roberts on the National Federation of Independent Business v. Sebelius (NFIB). It mentions the illogical and confusing views from reform supporters due to the reasoning of the Supreme Court that resulted to failure of reconciling the mandate and choice frames. It states the victory of ACA in transforming the idea of shared responsibility of the healthcare system. It adds the developed counter narrative of scholars including Akhil Amar, Robert Cooter, and Neil Siegel.
