- Abstract
The article discusses eminent domain, the protection of private property rights, and a proposed statutory solution which is aimed at reforming the U.S. takings practices as of October 2012, focusing on the U.S. Supreme Court's ruling in the case Kelo v. City of New London. The use of eminent domain as a means of promoting economic development is addressed, along with an examination of several legislative responses to the Kelo decision such as a ban on tax revenue-based takings in Kansas.
