- Abstract
The article examines the use of decisions in U.S. Supreme Court cases Williams v. Taylor, Wiggins v. Smith and Rompilla v. Beard as examples that illustrate the application of the American Bar Association (ABA) Standards for Criminal Justice. It provides a brief history of ineffective assistance of counsel jurisprudence. It discusses the original guidelines approach. It explores the rulings, and the jurisprudential change these opinions establish as a result of their reliance on the ABA standards. It traces the historical emphasis on the pre-trial investigation and mitigation phases in capital cases.
