- Abstract
The article explores the use of international law within the framework of the U.S. constitutional interpretation. It considers the process and substance of the international law as persuasive authority. The law plays a part in the nations' constitutional adjudication in an ad hoc manner. For the Supreme Court to use the law, factors such as the international ramifications of the case, nature of the international norms, and the position of the states in international rule are to be considered.
