The article examine the approaches to takings claims related to rail-to-trail conversions in the U.S. Topic discussed include the General Railroad Rights-of-Way Act of 1875; offsetting benefits to the remainder property in a rail-to-trail conversion and ways Surface Transportation Board evaluate the desirability of each rail-to-trail conversion prior to transferring the land to a trail operator.
