- Abstract
The article focuses on how U.S. Supreme Court case Timbs v. Indiana does more than hold that the Eighth Amendment's Excessive Fines Clause applies to state and local authorities based on the Fourteenth Amendment's Due Process Clause and Indiana's argument that civil in rem forfeitures. It mentions police can seize property with limited judicial oversight and retain it for their own use and to abuse the power to punish using economic sanctions.
