REFORMING ARTICLE V: THE PROBLEMS CREATED BY THE NATIONAL CONVENTION AMENDMENT METHOD AND HOW TO FIX THEM.
- Authors
Rappaport, Michael B.
- Abstract
The article discusses the procedures for using the national convention to propose a constitutional amendment of Article V of the Constitution in Virginia. It argues that such amendment is cited as defective due to uncertainties about the process and the possibility of a runaway convention or state legislatures are unlikely to apply for a convention. Also explored is the normative and interpretive implications on the failure of the national convention amendment method.
