- Abstract
The article examines the effectiveness of the sui generis Plant Variety Protection (PVP) law in India. It provides an overview of the enactment of sui generis PVP law, in which the first draft was prepared at the Indian Council of Agricultural Research in 1993. It notes that the law has a blend of intellectual property rights (IPR)-savvy and public interest provisions. The legislation is said to be not effective particularly for the protection and commercial use of extant varieties, such as premium farmer's varieties.
