- Abstract
The article presents the analysis on perception of fairness and decision on the assignment of defence counsel to Dragomir Milošević's case by the International Criminal Tribunal for the Former Yugoslavia (ICTY). It mentions on the surprising decision of the Trial Chamber in which the decision of the assignment of the counsel to Milošević was brought only after the completion of the prosecution's case and the accused was about to act pro se or represent himself for his defence. It also notes on the denial of the right of the accuse to act pro se which is clear to the Trial Chamber that this could produce the perception of fairness in many quarters. It cites that the accused's right of pro se is firmly established in the human rights law must weigh heavily.
