- Abstract
The article presents information on the opposing decisions issued by two investment arbitration tribunals based on the procedural or substantive rights of investors under the investment treaties. A focus is on the need of important case law in investment and the interpretation of North American Free Trade Agreement (NAFTA). The general international law related to obligations, its implications and ramifications are also discussed.
