- Abstract
The current use of soils is based mostly on property rights and on planning legislation. It does not take account of local and global ecosystem services. To develop sustainable territories, taking the example of community gardens, our paper suggests that governance of land use should be based on democratic local debate. It proposes also to separate soil property should rights from legislation related to common public services attributed by users to such spaces. This could encourage the creation of common land goods set within the legal framework of local authorities.
