- Abstract
The article "HR Analytics, Data Protection, and Labor Law" deals with the expansion of HR tools in the healthcare sector and the associated data protection and labor law issues. HR analytics in healthcare aims to increase work productivity and reduce turnover rates by analyzing personnel-relevant data. Data protection regulations must be observed when processing personal data. The processing of sensitive data, such as health data, is generally prohibited unless there are labor or social law requirements. A data protection impact assessment is required when a processing method poses a high risk to the rights and freedoms of affected individuals. The text addresses various aspects of data protection in labor law. Various articles of the General Data Protection Regulation (GDPR) are cited, which deal with the processing of employee data, employee consent, handling of health data, and the appointment of a data protection officer. The text also discusses the need for appropriate data protection measures and the role of the works council in ensuring data protection compliance. The text emphasizes the importance of reporting data breaches to the data protection authority. The specialist article addresses the topic of HR analytics, data protection, and labor law. It is pointed out that the works council plays an important role in the processing of personal data. The consent of the works council is required when introducing control measures or technical systems for monitoring employees, especially if these measures affect human dignity. The introduction or modification of systems for automated processing of personal data also requires the consent of the works council. The participation of the works council is also required when introducing personnel questionnaires that collect information about personal circumstances or opinions of employees. Labor law aims to achieve a balance of interests for the benefit of employees and the company and restricts the use of personal data.
