- Abstract
The Judgment of the Superior Court of Justice of the Valencian Community 30/2023 of January 24 is about a case of noise pollution in Valencia. The City Council of Valencia appealed Judgment 48/2020 of the Contentious-Administrative Court, which upheld the appeal against the City Council's resolution dismissing the claim for financial liability for the damages caused by noise pollution. The claim was filed by a couple and their minor children due to the noise generated by a café in the building where they lived. Despite the complaints and interventions by the Local Police, the couple decided to leave the property in 2015 and filed a claim for financial liability. The Chamber of the Superior Court of Justice dismissed the appeal and confirmed the amount of 57,635.50 euros as compensation for the damages suffered. The case highlights the importance of seriously addressing noise pollution, as it can significantly affect people's health and well-being.
