- Abstract
The article discusses a court case wherein the U.S. Supreme Court held that the supplier of some chemicals that polluted the site of pesticide distributor Brown & Bryant Inc. was not liable for response costs. In Burlington Northern & Santa Fe Railway Co. v. United States, the Environmental Protection Agency (EPA) and the California Department of Toxic Substances Control (DTSC) brought recovery actions against supplier Shell Oil Co. and the railroads after spending millions in remediating the site to protect drinking water.
