- Abstract
This article presents information on uninsured motorists. When an administrator of an estate sought to recover under two separate automobile policies covering two automobiles owned by the deceased, each of which contained uninsured motorist coverage, a court ruled the estate was entitled to recover on both. Holding the "other insurance" clause invalid as a result of the enactment of the uninsured motorist statute, the court found a double premium had been paid and since it is not required that the insured be occupying the motor vehicle to which the policy is attached, it would be "unconscionable" to permit the insurance company to avoid payment.
