The author discusses the court case of Smith v. Canada and argues with the Federal Court on the basis of Convention Relating to the Status of Refugees. He further discusses the litigation approaches taken in this trail by conducting a doctrinal analysis. It also informs that Smith and others are influencing the Canadian government for allowing services members of the U.S. to stay in Canada.
