- Abstract
After the women took place as workers, the necessity of protecting the women in the worklife has arised. The protection was firstly held by the international organizations and for this purpose various rules (conventions and directives) have been enacted, which are designed to promote the equality between men and women and to prevent the gender inequality. These regulations contain provisions on various measures such as the ones, which abolish the income inequality, design the limitation of working hours, and declare the workplaces and types of work, which are not suitable for the women workers. In the course of time, the international regulations regarding the protection of women employees have also had an impact on turkish law. Turkish constitution states that the men and women workers have the equal rights, however the woman employees are granted by special rights in terms of working conditions. These constitutional principles have already been adopted by the turkish labour legislation. This article discusses the harmonization of the Turkish Labour Act No. 4857, which was enacted in 2003, and the further related legislation in Turkey to the international rules, especially to the ILO conventions and to the directives of the European Union. In conclusion, the author points out the fact that, the turkish and international legislation have already been successfully harmonized to a wide extent, whereas the development of the legal practice in the same way has failed.
