- Abstract
The article analyzes the Indiana law allowing for delegation of the power to consent to marriage to the guardian. Topics discussed include the role of parens patriae power in the ability of a court to create and assign a guardianship, types of restrictions imposed by Indiana on marriage in guardianship proceedings, and the ability of the state to regulate marriage in light of the constitutional right to marriage.
