- Abstract
The article focuses on the legal issues of companion animal trust and custody laws that safeguard the interests available for elder pet guardians to protect their companion animals in the event of death or incapacity. It discusses the court case In Re Estate of Russell, wherein the gift of Thelma Russell to her dog Roxy Russell was held invalid because a dog cannot be a beneficiary in a will. It suggests that all states should support the formation of pet trusts.
