The article discusses the potential impact of judicial interpretation concerning the Employee Retirement Income Security Act of 1974 (ERISA) on the position of benefit plan participants in the U.S. It states that judicial decisions of restricting the rights of employee benefit plan participants could have affected the latter's overall stance if the said law had not been ratified. It explores the history of ERISA and the assurance it has provided for plan participants.
