- Abstract
The author reflects on the implications of accommodation doctrine that affords protection to surface estate owners in Texas on oil and gas law and policy in the state. Topics discussed include a brief history of the accommodation doctrine in Texas, the Texas Supreme Court' decision in case Merriman v. XTO Energy, Inc. that addressed issues surrounding the law of the accommodation doctrine, and bargaining power between mineral owners and surface owners in Texas.
