The author discusses the standard and calibrating deference to the strength of a proposed patent reform in the U.S. He states that the entry of too many invalid and weak patents through the Patent and Trademark Office (PTO) is the foremost problem of the patent system. The author adds that great strength into patents and their protection is provided by the Court of Appeals for the Federal Circuit.
